"Scariest Pet Contest" Rules
WHO'S ELIGIBLE: Members of EnergizedSeller.com who are current, legal residents of the continental U.S. and at least 15 years of age.
WHAT TO DO: To qualify, members must submit an original photo of their pet. The pet should look at least little frightful and funny (As opposed to just mean).
DEADLINE: Entries will be accepted starting at 12:00 a.m. Central Time on May 1, 2008 and ending at 11:59 p.m. Central Time on March 31, 2009. All electronic entries must be posted on the contest Web site or by 11:59 p.m. Central Time on March 31, 2009. Late entries will not be accepted.
WHERE TO SEND ENTRIES: EnergizedSeller.com members may enter online by posting their picture on the contest web page at http://www.energizedseller.com/ under the appropriate section. Multiple entries will be accepted as long as they are of different pets. Only one picture per pet, please. All entries must be from members who have accepted the Terms of Service Agreement.
JUDGING: Entries will be judged on the most frightful/funny photos as determined by the EnergizedSeller staff/team. Then, 3-10 photos, depending on the number of submissions, will be chosen as finalists by April 15, 2009 and put on a special section of the site where they will be voted on by the web site's visitors and/or members. The winner will be chosen June 15, 2009.
PRIZE: The person who submits the winning photo will win a $500 gift certificate to Lowes or Home Depot (winner's choice).

1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE CHANCES OF WINNING. Scariest Pet Contest ("Contest") is void where prohibited and is subject to all federal, state, and local laws and regulations. Open to legal residents of the continental United States who are members of EnergizedSeller.com when the photo is submitted. Contest begins on May 1, 2008, at 12:00 a.m. Central Time and ends on June 15 2009, at 11:59 p.m. Central Time. To be eligible, all electronic entries must be posted on the Web site by 11:59 p.m. Central Time on March 31, 2009.
2. HOW TO ENTER: Members of EnergizedSeller.com who are current, legal residents of the continental U.S. and are 15 years of age or older, must submit an original photo of a scary but funny looking pet that could make showing a home somewhat problematic. All submissions become the property of Seller Ventures, LLC dba EnergizedSeller.
By entering and participating in the Contest, each entrant warrants that his/her entry is original, and that it does not infringe upon the rights of any other party. Further, each entrant agrees that his/her entry will not contain any material that is libelous, slanderous, inaccurate, false, incomplete, patently offensive, illegal, pornographic, obscene or potentially dangerous or harmful in any way. Entries generated by a script, macro or other automated means will be disqualified. Throughout the Contest period, Sponsors may, in their sole discretion, post a daily sample script(s) on the Web site. Entrants acknowledge and understand that daily sample scripts may not be selected pursuant to the judging criteria set forth below, and selection of an entry as a daily sample script does not indicate that such daily sample script is or may be a winning script. Entrants further acknowledge and understand that their entries may be selected for posting as a daily sample script on a date after the actual date of submission.
3. ELIGIBILITY: The Contest sponsor is Seller Ventures, LLC dba EnergizedSeller (collectively, "Sponsors"). Sponsors' employees, immediate family members (defined as mother, father, in-laws, grandmother, grandfather, brother, sister, son, and daughter), members of their households, parent companies, respective affiliates, subsidiaries, sales representatives, distributors, advertising, promotion and public relations agencies are not eligible to enter. Seller Ventures, LLC dba EnergizedSeller is the administrator of the Contest and is responsible for fulfillment of the prize. Entrants should look solely to Seller Ventures, LLC dba EnergizedSeller with any questions, comments, or problems related to the Contest. Home Depot and Lowes are not sponsors of this contest.
4. SELECTION OF WINNERS: Entries will be judged on the funniest, scariest photos as determined by the EnergizedSeller staff/team (or those otherwise selected by Seller Ventures, LLC). Then, 3-10 photos, depending on the number of submissions, will be chosen as finalists by April 15, 2009 and then put on a special section of the site where they will be voted on by the web site's visitors and/or members. The photo with the most votes will be chosen as the winner. The winner will be chosen June 15, 2009 at 11:59 p.m. Central Time. All matters related to the Contest are final. The winners will be notified on or around June 16, 2009 via e-mail or telephone that, subject to verification, they are the winner. If a selected entrant cannot be reached after a reasonable effort has been made, or if an entrant is found to be ineligible, an alternate winner may be selected. If a prize or prize notification is returned as undeliverable, the selected entrant may be disqualified, and an alternate winner may be selected. Each winner (or winner's parent/legal guardian if the winner is a minor) may be required to sign an Affidavit of eligibility/Release of Liability/Publicity within fourteen (14) days of notification, or an alternate winner may be selected.
5. PRIZE: The person who submitted the best photo will win a $500 gift certificate to Lowes or Home Depot (their choice).
Only one prize will be awarded per person. Prizes won by minors will be awarded to a parent/ legal guardian. Prizes are non-transferable and may not be substituted by the winner. All prizes legitimately claimed will be awarded. Sponsors reserve the right to substitute prizes of equal or greater value for prizes that become unavailable. Taxes, if any, are the sole responsibility of the winner, as applicable. Terms of issuer apply to all gift certificates.
6. WINNERS' LIST AND COPY OF RULES: For a list of all winners, prizes, or a copy of these rules, specify which, send a self-addressed, stamped envelope to: Winners/Contest Rules, "Scariest Photo," c/o EnergizedSeller, 100 W. Houston St., Ste. 1616, San Antonio, TX 78205. Requests for winner's name must be received no later than six months after the close of the Contest.
7. LIMITATION ON LIABILITY/DISCLAIMER/OTHER REQUIREMENTS: All entrants, as a condition of entry, agree to be bound by these official rules and the decisions of Sponsors, whose decisions shall be final and binding in all respects, including without limitation, decisions regarding eligibility, winners, and the interpretation of terms in these official rules. Except where prohibited by law, by entering this Contest, each entrant and where applicable, the parent of each entrant, consents to the use of his/her name, voice, picture, likeness and biographical data and/or any other information contained in his/her entry, including, without limitation, his/her photo, in advertising, promotional and marketing materials by Sponsors and the Sponsor Affiliates (defined below) in all media now known or hereafter discovered without additional compensation, notice, review or approval. Sponsors further reserve the right to edit and/or publish entrants' photos, including, without limitation, on the Web site. All entrants further acknowledge that if they are chosen as a winner, certain of their personally identifying information may be disclosed to third parties at least as required by law, including, without limitation, on a winners' list. Sponsors are not responsible for any computer, telephone, electronic, Internet hardware or software, or any human or technical failures, malfunctions, corrupt transmissions, Internet accessibility, availability or technical error, or unauthorized human intervention, inaccurate capture of entry or other information, or the failure to capture any such information. Further, neither Sponsors nor the Sponsor Affiliates are responsible for any lost, late, illegible, misdirected, mutilated, incomplete or postage-due mail or e-mail. Entries that are incomplete, illegible or corrupted are void and will not be accepted. Sponsors are not responsible for any incorrect or inaccurate information, whether caused by Web site users, or by any of the equipment or programming associated with the Contest, and assume no responsibility for any error, deletion, omission, interruption, defect, delay in operation or transmission, technical error, human error, theft or destruction or unauthorized access to the Web site. Any person who supplies false information, enters by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize may forfeit the prize won and may be prosecuted to the fullest extent of the law. Sponsors reserve the right, at their sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Web site, or to be acting in violation of these official rules. Sponsors reserve the right to seek damages from any person deliberately attempting to undermine the operation of the Contest in violation of criminal and civil law. Sponsors' failure to enforce any term of the Official Rules shall not constitute a waiver of that provision. Sponsor is not responsible for damage to participants' or to any other person's computer related to or resulting from participating in this Contest. If the Contest is not capable of running as planned because of, but not limited to, infection by computer worms, bugs, viruses, tampering, fraud, technical failures, human error or any other causes which Sponsors, in their sole opinion, deem could corrupt or affect the administration, security, fairness, or proper conduct of this Contest, Sponsors reserve the right to cancel, modify, terminate or suspend the Contest and select the winners from entries received prior to the action taken or as otherwise may be deemed fair and equitable by Sponsors. Each entrant agrees not to knowingly damage or cause interruption of the Contest; prevent others from using the Contest; or obtain or modify another user's account information without his/her consent.
BY ENTERING, PARTICIPANTS RELEASE AND HOLD HARMLESS SPONSORS, THEIR RESPECTIVE PARENT COMPANIES, DIVISIONS, AFFILIATES, SUBSIDIARIES, TRUSTEES, FRANCHISEES, LICENSEES, ADVERTISING, PROMOTION AND PUBLIC RELATIONS AGENCIES AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE "SPONSOR AFFILIATES") FROM ANY AND ALL LIABILITY OR ANY INJURIES, LOSS OR DAMAGE OF ANY KIND ARISING FROM OR IN CONNECTION WITH THIS CONTEST, ENTRANTS' ACCESS TO OR USE OF ANY PARTICIPATING WEB SITE, OR ANY PRIZE WON.
